1. Main purposes of Privacy Policy

This Online Shop https://www.moyestore.com Privacy Policy, hereinafter referred to as „Online Shop” or „Service” is informative only, meaning that it is not a source of obligations for the Customers of the Online Shop, and it is not a contract nor terms and conditions. Should there be any doubts or discrepancies between the Policy and the consents given by a given person irrespectively of the provisions of the Policy, the voluntarily given consents or the provisions of law shall always be the basis for the Controller’s actions or for the determination of the scope of actions by the Controller.

Our aim is to ensure that the privacy of the Website Users is protected at a level at least equivalent to the standards set out in the applicable legislation, in particular the Act of 18 July 2002 on the provision of electronic Websites (Journal of Laws of 2002, no. 144, item 1204 as amended), the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) – GDPR (OJ EU L 119, p.1) and in the Act of 16 July 2004, Telecommunications Law.

2. Personal Data Controller

Okólnik 9A/11, 00-368 Warsaw, Poland), entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, REGON 360-425-775, NIP 525-260-54-03(contact at the above-mentioned mailing address, by e-mail at the address: studio@moyestore.com, hereinafter referred to as the “Controller”, who is also the Seller and Service Provider.

3.  Purposes of Personal Data Processing

The Website User may be asked to provide the following personal information: name and surname, residential address, telephone number, electronic mail address (e-mail address), password, and in the case of Customers who are not consumers, additionally the company name and tax identification number [NIP]. The personal data which the User is required to provide in order to use particular functionalities of the Website are marked and highlighted to stand out from the data the User may provide at his or her discretion. Personal data collected during the registration process are used to enable the User to log onto the Website or its subpages in order to use the functionalities which require the User to register, as well as to render MM Group s.c. obligations towards the User.

4. Rules of Personal Data Collecting

I  When the Users browse the contents of the Website, information on the manner in which the Users use the Website as well as their IP addresses are collected automatically, based on the analysis of access logs, e.g., browser type, operating system type, date and time of visit, number of connections, number of subpages opened on the Website, viewed content. Browsing the contents of the Website does not require the User to provide any personal data.

II The provision of Personal Data by the Customer in the Online Shop is voluntary. Personal data of Website Users will be processed for the purposes of registration in the Store, and in the case of granting the appropriate consent, for the marketing of our products and services and participation in the Newsletter service. In the case of the purchase of goods, personal data will be processed for the purpose of proper performance of the contract for the purchase and sale of our products, as well as their shipment. Failure to provide personal data necessary to conclude a Purchase and Sale Agreement results in the refusal to conclude this agreement. The data will be stored until the consent is withdrawn, or up to a maximum of 3 years from the moment of completing the order.

III Each and every list of recipients of the Personal Data processed by the Controller from time to time arises out of the scope of services used by the Customer. The list of recipients of data results also from the consents given by the Customer or from the law, and shall be clarified as a result of actions taken by the Customer in the Online Shop. Personal Data can be processed by  providers of hosting services or IT services, marketing companies, carriers or agents shipping the Orders, entities providing the service of electronic payments, as well as providers of legal and consultancy services.

5. Personal Data Protection

The Controller shall take special care for the purpose of protecting the data subjects’ interests, in particular, ensuring that the data collected by the Controller are processed lawfully, fairly and in a transparent manner in relation to the data subject, collected for specific, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes, adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed, accurate and, where necessary, kept up to date, kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed, processed in a manner that ensures appropriate security of the personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organizational measures.

7.  User’s Privileges

I The User has the right to request the access to and to obtain a copy of his or her data, to rectify (amend) the data, to transfer and erase the data, as well as the right to restrict the processing.

II In connection with our processing of your personal data, User has the right to lodge a complaint with the President of the Personal Data Protection Office.

COOKIES FILES

1. Cookies are small text information in the form of text files, sent by the server and saved on the side of the person visiting the Online Store website (e.g. on the computer’s hard drive or on the smartphone’s memory card). It stores information that the Online Store may need to adapt to the ways it is used by the Visitor and to collect statistical data regarding the Online Store (e.g. which pages were visited, what elements are downloaded) and data of the domain name of the Internet service provider or the Visitor’s country of origin.

2. Purposes of Cookies Files processing

I  The main purpose of using Cookies Files is to make it easier for the User to use the Website, to adjust the Website to the needs and expectations of a specific User.
